When should I instruct a solicitor?
Some par solicitors offer a "no sale, no fee" service so there is no risk in instructing such solicitors before you have agreed a sale or purchase. As a buyer, you can also instruct a par "no sale, no fee" solicitor as there is no risk in doing so. In fact, when you make an offer on a property, your position looks stronger if you have a solicitor already in place.
When will I have to pay money out?
As a seller, you will have to pay for a Home Information Pack before marketing can begin. Once you have secured a sale, your par solicitor may ask for some money up front when their work begins. The balance of the money from the sale will come to you on the day of completion. The solicitor will take their fee out at this stage, as will the par Estate Agent. As a buyer, your solicitor may ask for some money up front when their work begins. On Exchange of Contracts, you will be asked by your solicitor to provide 5% or 10% of the purchase price. On the day of completion, your mortgage money will come in to your solicitor who will pass it on to the seller.
