Patience And Contingency


The conveyancing process can be surprisingly  slow at times... Are you prepared for delays? In an ideal world, person A agrees to purchase person B's property. The solicitors get to work, contracts are exchanged, money is exchanged and the transaction is completed. In the no-so-ideal world, this process can get horribly held up by various unforeseen circumstances. These can include a bad solicitor somewhere in the chain, a mortgage offer being withdrawn, probate on a will, missing documents etc. etc. There are so many things that can delay the process. Make sure you have some slack and flexibility in your schedule an finances for unforeseen delays!

What happens during the ‘Exchange of Contracts’ ?


Exchange of contracts (EoC) is the point of the legal process where a binding obligation on both parties is created - for the Seller to sell and the Buyer to buy the property.

At any time up until the EoC point, either party could withdraw from the process without any penalty other than monies they have spent on surveys, mortgage application fees and similar costs....

At EoC  stage a completion date is normally mutually agreed when the transfer can and will be finalised.

On the day of completion the monies are transferred between the parties and, the keys to the purchased property are handed over to the buyer.
