What are searches?
As part of the process of purchasing your property, the solicitor you appoint will conduct searches on your behalf. (You must pay for these). The searches relate to the property you are buying - and check for various things. Is the current ownership of the property all in order? Is the seller in a legally sound position to do so? Is the environment OK (toxic ground, tree preservation orders, radon gas, flood-prone etc.). Is the land registered? What are the status of the mains water supply, drainage and sewerage? Are there mines or mining activity affecting the property? And so on. The purpose of the searches is to ensure that you are buying a property legally, and with no nasty surprises.
When should I instruct a solicitor?
Some Kendal solicitors offer a "no sale, no fee" service so there is no risk in instructing such solicitors before you have agreed a sale or purchase. In fact, as a seller, it is better to start the process early so that paperwork etc can be prepared in readiness for a sale.
