1. INTRODUCTION

1.1 This Site is owned and operated by AgentQuote.co.uk Ltd, hereinafter referred to as “AgentQuote”. Our registered address is 20 Tawe Business Village, Enterprise Park, SWANSEA, SA7 9LA. Our company is registered in England & Wales No. 6292991 and our VAT registration number is 921 7363 31.

1.2 These terms and conditions are deemed to include our Privacy Policy and are collectively known as "these Terms" and relate to all Agents who use the Site and all Sellers.

1.3 The terms “Site”, or “ Website” shall refer to this Website and the intellectual property of the AgentQuote operating system contained within this Site.

1.4 The terms “Service” or “System” may also be used as references to the AgentQuote System embodied within this Site.

1.5 The term “Seller” shall apply to persons registering their details as a seller or owner of property and the term "Agent" agent shall mean any agent wishing to sell or let a property on behalf of the Seller.

1.6 When you use this Site, you must agree to be bound by these terms and conditions. If you do not agree to be bound by these Terms, you must not use this website.

1.7 These Terms are a legal agreement between AgentQuote and the user and cannot be modified without our consent. AgentQuote can amend these Terms at their discretion and without notice to you at any time by publishing the amended Terms on the Site. The published version of these Terms will represent AgentQuote's most current Terms and will apply whenever you use this Site.

2. AVAILABILITY AND ACCESS OF THIS SITE

2.1 Whilst AgentQuote take every care in ensuring that the Site remains in constant operation, certain technical matters relating to system maintenance and faults may result in a disruption of service. AgentQuote cannot therefore guarantee that users will enjoy uninterrupted trouble-free access to the system at all times.

2.2 AgentQuote reserve the right to deny or restrict your access to the Site at any time on a permanent or temporary basis, at their discretion and without any notice. In this event you must not attempt to use this Site under any other name or through any other user.

2.3 This Site is intended to be accessed by persons who are UK resident only.

3. OWNERSHIP OF INTELLECTUAL PROPERTY AND ALL OTHER MATERIAL CONTAINED ON THIS SITE

3.1 AgentQuote is the owner of all copyright, design, and all other intellectual property rights that exist within this Site (including all database rights, trade marks, service marks, trading names, text, graphics, code, files and links) and within the workings of the AgentQuote System.

3.2 No user may copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Site.

3.3 Without limitation to clause 3.1, the device is our registered trademark. You may not use or copy it without the written prior consent of AgentQuote.

4. YOUR USER OBLIGATIONS AND CONDUCT

4.1 No user may use the Site in any way that causes or is likely to cause access to be interrupted, or impaired in any way and all users acknowledge and agree that they are responsible for electronic communications sent from their computer.

4.2 Users accept that they are solely responsible for ensuring that their computer system meets all relevant technical specification necessary to use this Site and that the computer system is compatible with this Site.

4.3 The user must agree that any data supplied has been checked and approved and is not confidential and without title. Any claims relating to the clarity or accuracy of the data arising from the Property Misdescriptions Act 1991 or any other such legislation will be the responsibility of the user, who will indemnify AgentQuote against any legal actions raised against AgentQuote as a result of the user's non-compliance.

5. REGISTRATION

5.1 To receive quotations from Agents registered with this Site the Seller must register their details with AgentQuote. All applications for registration are subjected to a validation procedure by email. AgentQuote will only accept the user's registration and forward details to Agents once the validation process has been complied with.

5.2 In order to provide you with a quotation for any additional services you may request through this site, we may have to pass your contact details on to a service provider who may in turn contact you to discuss your requirements. By requesting quotations for additional services through this site you are agreeing that you are willing to be contacted by our nominated third party service provider.

5.3 Each registration is on a single user basis only. The Seller may not share with nor disclose to any other person his or her username or password.

5.4 The user accepts sole responsibility for all use of and for keeping secret any account ID and password that may have been used in connection with the Site. The user will notify AgentQuote immediately of any unauthorised use of them or any other breach of security of this Site on becoming aware of the breach.

6. WARRANTY & LIABILITIES

6.1 Any information provided through using this Site is for general interest only and does not constitute specific advice or verified facts. AgentQuote makes no warranties, representations or guarantees with regard to using this Site.

6.2 AgentQuote makes no warranty, except in the case where a warranty or condition can be applied by statute, that this Site and the Services are free from errors that will affect the performance and suitability to their purpose or that they will continue uninterrupted.

6.3 Neither AgentQuote nor any of its agents, employees and sub-contractors shall be liable to the user or any other party for any claim, loss, demand or damages whatsoever (whether such claims, loss, demands or damages were foreseeable, known or otherwise) arising out of, or in connection with, the use of this Site.

6.4 The exclusion of liability includes, without limitation, indirect or consequential loss or damage; loss of actual or anticipated profits (including loss of profits on contracts); loss of revenue; loss of business; loss of opportunity; loss of anticipated savings; loss of good will; loss of reputation; loss or damage to or corruption of data; loss of use of money or otherwise, and whether or not advised of the possibility of such claim, loss, demand or damages and arising in tort (including negligence), contract or otherwise, to the fullest extent permitted by law.

6.5 AgentQuote is not party to the actual transactions between Sellers and Agents and does not review users' listings. AgentQuote shall not be held responsible for the actions or inactions of Sellers and Agents involved in transactions (whether such transactions are carried out on or off the Site). AgentQuote has no control over, does not guarantee, and will not be held responsible for the truth or accuracy of listings; the ability of Agents to sell properties; ensuring that Sellers and Agents actually complete transactions.

6.6 This Site provides the means for the Seller to make contact with Agents. AgentQuote has no control over the methods that Agents employ to conduct their business or of the level of proficiency or professionalism they will provide to the Seller. If the Seller decides to transact with any Agent or third party through this Site, he or she does so at his or her own risk.

6.7 We make no warranties on behalf of those parties referred to in 6.6.

6.8 When the Seller uses the "contact forms" on this Site to submit a request to appraise a property, the Seller's details (including their email address) will be sent by email directly to that Agent. AgentQuote do not accept any liability for any subsequent direct communications that you may receive from any Agent.

6.9 The details of the properties lead data available on this Site are provided to AgentQuote by the Sellers. AgentQuote cannot verify these details and therefore make no warranties or representations as to their accuracy or completeness, neither do AgentQuote verify any proper proof of title to the details being provided by the Seller/Owner. If Agents rely on this information, they do so at their own risk.

7. LEGAL JURISDICTION

7.1 In the event of any provision of this agreement becoming declared as invalid it shall to that extent be severed from the main body of this agreement and the remaining provisions shall continue to have full force and effect.

7.2 Any delay or failure of AgentQuote to enforce its rights under this agreement shall not be deemed to be a waiver of such rights to do so.

7.3 This agreement contains the entire agreement between the Parties and supersedes all prior arrangements and understandings whether written or oral with respect to the subject matter hereof and may not be varied except in writing signed by both parties hereto.

7.4 Nothing in this agreement constitutes a partnership or agency agreement between the parties. Neither party has the authority or powers to bind the other party to a contract in the name of, or create a liability against, the other party in any way or for any purpose.

7.5 AgentQuote shall not be held to be an agent or partner of any parties registered with this site.

7.6 This agreement shall be construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.

7.7 English law shall apply to these Terms. The user irrevocably agree that the courts of England will have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the exclusive jurisdiction of the English courts.

8. NOTICES

8.1 All notices shall be sent to AgentQuote by email to notices@agentquote.co.uk or by post to AgentQuote's registered address.

9. TELEPHONE CALLS AND EMAILS

9.1 This Site is intended to operate without the need to provide verbal contact or assistance from AgentQuote with regard to Site registration. AgentQuote therefore reserves the right not to respond to telephone calls and email correspondence with regard to general registration issues.
